wa 'alaykumus-salaam,

if you understand what the shaykh said about the Islaamic legitimacy of copyrights, then its clear - then these things are someone's property... The owners permissions' are to be sought before using their property.

When a person works for a year translating a book for example, he hopes to receive some compensation for his work from the book sales, likewise the one who designs a computer program, or any owner of some intellectual property.  When you take it from him and copy it and distribute it for free, yes this seems to aid the da'wah in the short term, however maybethe owner of the book will not receive any compensation because the book doesn't sell, as everyone can get it for free.  Short term, this only seems to harm the translator or owner of the copyright.  Long term, the translator is not able to do any more projects to benefit the Muslims because of this and thus no more work is produced.

And the people who just copied the material and distributed it are not able to produce anything, so in actuality they have harmed the da'wah in a very big way, and this is what the ulamaa' consider when dealing with issues - not just today's benefit, but the long term benefit/harms for the whhole community, and Allaah knows best.

Actually, the hizbees know this quite well, and that is why you find them copying the books of the salafees and distributing them for free, as they know it harms them financially and may decrease their productivity or even kill it, and we ask Allaah to preserve us and this da'wah.

I have 2 questions regarding this:-

1. What if there are no copyrights policies for a particular website or blog? Is it still necessary to mention the source? I know of one person's blog who infact recommends people to not give the source as his/her blog when they forward his articles,etc.

2. In such a case if it is a Salafee website/blog without copyrights then there is no problem in mentioning the source. However, if the source has mixed content(some Salafee and some deviant) and they don't have any copyrights policies and don't mind not being referenced, in this case is it better to not mention the source at all or mention the source with a disclaimer?
