Assalamu alaykum wa rahmatullahi wa barakatuhu!

May Allah subhanahu wa ta'ala reward all of you for this forum!Amin.

I need some help on this topic: mental disability.

My brother has a boy of 8 years old, who has autism. His father wants to know what type of treatment will receive the child in the Day of Judgement, regarding on what Allah has reveiled by His ghayb and what the Sunnah of the Prophet sallahu alayhi wassalam said.

If someone can ask to the 'Ulama, or has materials in english, or lectures, is welcome to make me know inshaAllah.

wa 'alaykumus-salaamu wa rahmatullaahi wa barakaatuh.

If a child (or adult) can not understand what is being said to him or can not communicate his belief for some reason, whether due to deafness or mental disability or the likes, he will be tested on the Day of Judgment, as mentioned by the Prophet (sallallaahu 'alayhe wa sallam) in what is called "the hadeeth of the imtihaan" where he said that three kinds of people will come on the Last Day with proofs in their favor... one of them will say, "O Allaah!  Your messenger came to me but I did not understand a thing!"  Allaah will take a special oath from them that they will obey His Order and then He will order them to enter a fire.  Those who go to Paradise will enter this fire finding it cool and soothing.  Those who refuse will go to Hell.  The hadeeth is authentic and its sources and discussions around its meanings can be found on a lecture called "Rulings on the Children of the Mushrikeen" available at TROID.

Wa'alaykum as-salaam warahmatullaahi wabaraakathu.

This is an interesting subject as I myself have a brother with Autism and how this ties in with Yaum al-Qiyaamah is obviously important for us.

There exist ahaadeeth on this topic and 'ulema have spoken on this also, I will post some of what I can find here, inshaa'Allah.

The Prophet (sallAllahu 'alaihi wasalaam) said: "Every child is born in a state of fitrah (the natural disposition of man, then his parents make him a Jew, or a Christian, or a Magian".
(Narrated by al-Bukhaari (1296) and Muslim (4803))

The Prophet (sallAllahu 'alaihi wasalaam) said: "The Pen is lifted from three (i.e. their deeds are not recorded); the sleeper until he awakes, the child until he grows up and the insane until he regains his sanity or regains consciousness".
(Narrated by the authors of the Sunan an classed as saheeh by Shaykh al-Albaani in al-Irwa' no.297)


Shaykh al-Islam ibn Taymiyyah (rahimahullaah) said: "The ruling on one who is insane is like the ruling on a child; if his parents are Muslim then he is also Muslim. This is according to the consensus of the Muslims. The same applies if his mother is Muslim according to the majority of scholars such as Abu Haneefa, ash-Shaafi' and Ahmad. Similarly, one who becomes insane after becoming a Muslim is regarded as being outwardly Muslim. An insane person who was born in a Muslim society is also regarded as being Muslim, as is his parents or the people of his society, as is also the ruling on children. The children of the Muslims and their insane will be like their fathers (i.e. they will be counted as Muslims) on the Day of Resurrection".
(Majmoo' al-Fataawa 10/437)

Ibn Hazm (rahimahullaah) said: "As for the insane who have no mental faculties until they die, as we have already mentioned, they are born as 'haneefs' (monotheists) and believers, and they do not change their faith. So they die as believers and so they will go to Paradise".
(al-Fasl 4/135)

It is important to note that Ibn Taymiyyah's words quoted above "if his parents are Muslim then he is also Muslim. This is according to the consensus of the Muslims" are regarding the worldy rulings on them only.  Meaning: Do they inherit from us?  Are they buried in our graveyards?  and so on

This is known since the issue o their Hereafter is one of great differing among the scholars, and clearly since Ibn Taymiyyah himself held the position that such children were not automatically in Paradise, rather they will be tested first.

It was also the position of Abul-Hasan al-Ash'aree, al-Bayhaqee, and the students of Ibn Taymiyyah like Ibn Katheer and Ibn al-Qayyim.  Al-Albaanee and 'Abdul-'Azeez ibn Baaz also held this position.  May Allaah have Mercy on all of them.

This does not contradict any of the authentic texts in the issue.  Meaning:

The pen is lifted - and they will be tested in the Hereafter.

They were born on the fitrah - and they will be tested in the Hereafter.

The lecture I mentioned could be studied for those who are especially interested in the topic - as it contains the relevant texts in the issue and what a large number of scholars have deduced from them, and their refutations and responses of one another.  May Allaah bless you.
