حكم التقبيل عند اللقاء، والمعانقة، والالتزام، وتقبيل يد العالم

The ruling of kissing upon meeting and hugging and grasping and kissing the hand of the 'Alim (scholar)


عن أنس بن مالك قال قال رجل يا رسول الله أحدنا يلقى صديقه أينحني له قال رسول الله صلى الله عليه وسلم لا . قال فيلتزمه ويقبله قال لا . قال فيصافحه قال نعم إن شاء .
والسياق لأحمد وكذا الترمذي لكن ليس عنده إن شاء ولفظ ابن ماجه نحوه وفيه ولكن تصافحوا . ( حسن )


On the authority of Anas bin Maalik he said a man said:

"o messenger of Allah one of us meets his friend should he bow his head to him, the messenger of Allah sallahu alayhi wa salam said no. He said should he grasp him and kiss him, he said no. He said should he shake hands with him, he said yes if he wills."

قال الشيخ الألباني ـ رحمه الله تعالى ـ في سلسلته الصحيحة المجلد الأوّل ـ تحت حديث رقم (160 ) ـ :

Shaykh Albanee,rahimahullah, said in Silsila ahadeeth as saheeha, first volume, under the hadeeth number 160:

( ..فالحقُّ أنّ الحديث نصٌّ صريح على عدم مشروعية (التقبيل) عند اللقاء ، ولا يدخل في ذلك تقبيل الأولاد والزوجات ؛ كما هو ظاهر ..

so the true reality is that the hadeeth is a clear cut text showing the prohibition of kissing upon meetingand kissing the children or wives does not fall into that, as is apparent.

وأمّا الأحاديث التي فيها أنّ النبيّ صلي الله عليه وسلم قبّل بعض الصحابة في وقائع مختلفة ؛ مثل تقبيله واعتناقه لزيد بن حارثة عند قدومه المدينة ، واعتناقه لأبي الهيثم بن التيهان ، وغيرهما ؛ فالجوّاب عنها من وجوه :

As for the narrations in which the prophet sallahu alayhi wa salam kissed some of the companions in different incidents, for example him kissing and hugging Zayd bin Haaritha upon his return from Madinah, and him hugging Abul Haytham bin tayhaan and other than them, then the response to this is from a number of angles:

(الأول ) : أنها أحاديث معلولة لا تقوم بها حجة ، ولعلنا نتفرغ للكلام عليها ، وبيان عللها إنْ شاء الله تعالى .
( الثاني ) : أنه لو صحّ شيء منها ؛ لم يجز أن يعارض بها هذا الحديث الصحيح ؛ لأنها فعل من النبيّ صلي الله عليه وسلم يحتمل الخصوصيّة أو غيرها من الاحتمالات التي توهن الاحتجاج بها ، على خلاف هذا الحديث ؛ لأنه حديث قوليّ وخطاب عام موجّه إلى الأمة ؛ فهو حجة عليها ؛ لما تقرر في علم الأُصول أنّ القول مقدّم على الفعل عند التعارض ، والحاظر مقدمٌ على المبيح ، وهذا الحديث قولٌ وحاظرٌ ، فهو المقدّم على الأحاديث المذكورة لو صحّت .


first, they are narrations which are ma'loola (defective) and a proof cannot be established by way of them,and hopefully we shall complete our speech upon them and make clear its defect if Allah the most high wills.

second, if there was anything authentic from them, it would not be allowed to contradict by way of them this authentic narration. Because they are actions from the prophet sallahu alayhi wa salam, it is possible that they are from those actions which are particular for him, and other than them from the possibilities which weaken it being used as a argumentation/proof, as opposed to this narration which is a verbal hadeeth and a general address directed to the ummah, and it is an evidence against them (narrations), as it is affirmed in the knowledge of usool that the statement takes precedence over action when there is a contradiction, and the thing being prohibited takes precedence over the thing permissible, and this is a verbal and prohibitive narration, so it takes precedence over the mentioned narrations, if they are infact to be authentic.

## وأمّــا ( الالتزام ) .. و ( المعانـقة ) ؛ فما دام أنّه لم يثبت النهي عنه في الحديث كما تقدم ؛ فالواجب حينئذٍ البقاء على الأصل ، وهو الإباحة ، وبخاصّة أنه ببعض الأحاديث والآثار ،
فقال أنس رضي الله عنه : " كان أصحاب النبي صلى الله عليه وسلم إذا تلاقوا ؛ تصافحوا ، فإذا قدموا من سفرٍ ؛ تعانقوا " . رواه الطبراني في الأوسط ، ورجاله رجال الصحيح ، كما قال المنذري (3/270) ،والهيثمي (8/36) . وروى البيهقي (7/100) بسند صحيح عن الشعبي : " كان أصحاب محمد صلى الله عليه وسلم إذا التقوا ؛ صافحوا ، فإذا قدموا من سفر ؛ عانق بعضهم بعضاً ". وروى البخاري في الأدب المفرد (970) ، وأحمد (3/495) عن جابر بن عبد الله قال : " بلغني حديث عن رجلٍ سمعه من رسول الله صلى الله عليه وسلم ، فاشتريت بعيراً ، ثمّ شددتُ عليه رحلي ، فسرتُ إليه شهراً حتى قدمتُ عليه الشام ، فإذا عبد الله بن أنيس ، فقلت للبـواب : قل له : جابر على الباب . فقال : ابن عبد الله ؟ قلتُ : نعم . فخرج يطأ ثوبه فاعتنقني واعتنقته " الحديث . وإسناده حسن كما قال الحافظ ( 1/ 195) ، وعلّقه البخاري . وصحّ التزام ابن التَّيِّهان للنبي صلي الله عليه وسلم حين جاءه صلي الله عليه وسلم إلى حديقته ؛ كما في مختصر الشمائل (113) .
## وأمّــا ( تقبيل اليـد ) ýفـفي الباب أحاديث وأثار كثيرة يدلُّ مجموعها على ثبوت ذلك عن رسول الله صلي الله عليه وسلم والسلف ، فنرى جــواز (تقبيل يد العـالم ) إذا توفّرت الشـروط الآتية :
1 _ أنْ لا يتخذ عادةً بحيث يتطبع العالم على مدّ يده إلى تلامذته ، ويتطبّع هؤلاء على التبرك بذلك ، فإنّ النبي صلي الله عليه وسلم وإنْ قُبلت يده ؛ فإنما كان ذلك على الندرة ، وما كان كذلك ؛ فلا يجوز أن يُجعل سنة مستمرة ؛ كما هو معلوم من القواعد الفقهية .
2 _ أنْ لا يدعو ذلك إلى تكبر العالم على غيره ورؤيته لنفسه ؛ كمــا هو الواقع مع بعض المشايخ اليوم .
3 _ أنْ لايؤدي ذلك إلى تعطيل سنة معلومة ؛ كسنة المصافحة ؛ فإنها مشروعة بفعله صلي الله عليه وسلم وقوله ، وهي سببٌ شرعيّ لتساقط ذنوب المتصافحين ؛ كما روي في غير ما حديث واحد ؛ فلا يجوز إلغاؤها من أجل أمر أحسن أحواله أنـه جائـز . ) ا.هـ
