Bismi'llaah wal hamdu lilaah was-salaatu wa salaam 'ala Rasulilaah wa ba'd: as-salaamu 'alaykum, Does anyone know the specific ruling (or where to find it) concerning the purchase of an old church (from the mushrikeen) for the purpose of turning it into a masjid?

From Talq ibn Alee, radiyallaahu 'anhu who said: "We went out as a delegation to the Prophet, sallallaahu alaihe wa sallam. We made the bay?ah with him and offered the salaah with him. We told him that in our land we had a place of worship and we asked him to give us some of the water used from his wudoo, so he called for water and performed wudoo and rinsed out his mouth, then he poured that water into a container and told us, | quote: |
"Depart , and when you arrive to your land, knock down that place of worship and sprinkle this water over the place, then adopt it as masjid" |

We said, 'Our land is far away and the heat is intense, the water will dry up.? He said, ?Add more water to it, it will only increase it in goodness.? So we set out and when we reached our land, we knocked down our place of worship, sprinkled water on the place and adopted it as a masjid. We called the Aadhaan there, and when the monk, a man from Tayyi?, heard it, saying, "[This is] the call of truth"! Then he climbed one of our hills and we never saw him again". Collected by al-Imaam an-Nasaa'ee and graded authentic by Shaikh al-Muhaddith Muhammad ibn Aadam al-Eetheeoobee.

salaam alaykum, most churches have graves besides or near by, if we are to buy the church with the grave yards, what are we to do with the graves? *in kafir country *in a muslim country
