Salamu alaikum wa rahmatullah;

Seeking the correct Daleel for one who prays and later remembers he was not in Wudoo, does he need to perform Wudoo and repeat the prayer once he remembers this for sure? [i.e. Perform Qada']

Shaikh Muhammad bin Saalih al-Uthaymeen discussed this issue saying, ..... And the well known principle with the people of knowledge is that THERE IS NO EXCUSE LEAVING A 'MA'MOOR' (what you have been ordered with) DUE TO FORGETFULNESS AND IGNORANCE. So if someone was to pray without Wudoo Naasiyan (due to forgetfulness), then it is upon him to repeat his prayer after he makes wudoo because he fell short in a condition that he must perform. His is not sinful with regards to his prayer without wudoo due to his forgetfulness due to the saying of Allaah (Surah Baqarah. aayah 286) but the salaah is not correct.

wa alaikum salam wa rahmatullah;

When I went to print this out for a brother at our masjid, another statement appeared from antoher brother quoting Shaikh Ibn Baaz [rahimahullah] about one who doubts his Wudoo and another statement by Shaikh Abdur-Rahman as-Suadias to the affect that one doesn't have to make up the prayer. Now I'm wondering is there ikhtilaf baina Ulamaa on this matter?

بسم الله الرحمـن الرحيم

The issues of one (a) doubting his wudoo' and (b) praying and then realizing that he did not have wudoo' are two different issues with different rulings.

When a person doubts whether or not he has wudoo', then he should base his judgement on what he is certain of (بنيَ على اليقين). Thus, if he is certain that he made wudoo' yet doubts that he might have lost it, then his wudoo' is valid and he should pray as he normally would. Conversely, if he is certain that he broke his wudoo' yet doubts that he might have performed wudoo', then he must perform wudoo' before praying. That is likely what was attributed to Shaykh Bin Baaz.

As for the second case, regarding the one who prayed then later realized that he didn't have wudoo', then his salaah is not valid according to the most dominant and acceptable opinion (as stated by Saalih al-Fawzaan). And the evidence is the statement of the Prophet (sallallaahu alayhi wasallam):

لا يقبل الله صلاة أحدكم إذا أحدث حتى يتوضأ

Allaah does not accept the prayer of one of you if he makes al-hadath (the passing of something from the two private parts) until he performs wudoo'. [Agreed upon by al-Bukhaaree and Muslim]
Thus, wudoo' (or tahaarah from al-hadath, which is the more precise terminology used by the fuqahaa') is a condition for the acceptance of the salaah, and no salaah is accepted without it, except in the extreme case where a person is neither able to perform wudoo' nor tayammum. And Allaah knows best.
