حكم من يصلى الفجر بعد طلوع الشمس  
السؤال بتاريخ 2003-03-01 05:00 ص
لي صديق يسكن بالقرب مني ، والمسجد قريب منا جدا ، وصديقي لا يذهب لصلاة الصبح ويقضي وقت الليل في مشاهدة التلفاز ولعب الورق ويسهر حتى الساعات الأولى من الصباح ولا يصلي الصبح إلا بعد طلوع الشمس ، ولقد عاتبته كثيرا وكان عذره أنه لا يسمع الأذان مع أن المسجد قريب منا جدا ، وقد أبديت له رغبتي بأني سوف أوقظه لصلاة الصبح ، وفعلا أذهب إليه وأوقظه ، ولكنني لا أشاهده في المسجد ومن ثم آتي إليه بعد الصلاة وأجده نائما فاعتب عليه ويعتذر بأعذار واهية ، وكان يقول لي في بعض الأحيان : إنك مسؤول عني أمام الله يوم القيامة ؟ لأنني جارك .

أرجو من سماحتكم أن تفيدوني في ذلك ، وهل أنا ملزم فعلا بإيقاظه للصلاة ؟

لا يجوز للمسلم أن يسهر سهرا يترتب عليه إضاعته لصلاة الفجر في الجماعة أو في وقتها ، ولو كان ذلك في قراءة القرآن ، أو طلب العلم ، فكيف إذا كان سهره على التلفاز أو لعب الورق أو ما أشبه ذلك . . ؟

وهو بهذا العمل آثم ومستحق لعقوبة الله سبحانه ، كما أنه مستحق للعقوبة من ولاة الأمر بما يردعه وأمثاله .

وتأخير الصلاة إلى ما بعد طلوع الشمس كفر أكبر إذا تعمد ذلك عند جمع من أهل العلم ؛ لقول النبي صلى الله عليه وسلم : " بين الرجل وبين الشرك والكفر ترك الصلاة " رواه مسلم في صحيحه ، ولقوله عليه الصلاة والسلام : "العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر " أخرجه الإمام أحمد ، وأهل السنن ، عن بريدة بن الحصيب رضي الله عنه بإسناد صحيح .

وفي الباب أحاديث أخرى وآثار تدل على كفر من أخر الصلاة عن وقتها عمدا وبلا عذر شرعي .

والواجب على المسلم أن يحافظ على الصلاة في وقتها ، وأن يستعين على ذلك بمن يوقظه لها من أهله أو إخوانه ، أو بإيجاد ساعة يؤكدها على وقت الصلاة .

وعليه وعلى أمثاله ألا يسهر سهرا يسبب نومهم عن صلاة الفجر ولو في أمر مباح أو مستحب ، فكيف إذا كان السهر على ما هو محرم

من الملاهي أو مشاهدة ما حرم الله في التلفاز أو غيره ؟ أصلح الله حال الجميع .

وعليك أيها السائل أن تعينه على ذلك ، وتنصحه كثيرا ، فإن أصر على عمله القبيح فارفع أمره إلى مركز الهيئة حتى تعاقبه بما يستحق ، ولا يلزمك أن توقفه ما دام على فعله القبيح لا ينتفع بالإيقاظ ولا يأخذ بالأسباب .

نسأل الله للجميع الهداية والاستقامة على الحق.

The ruling on the one who prays Salatul Fajr after the sun has risen.

Question: I have a friend that lives close to me, and the Masjid is very close to both of us. And my friend does not go to the Masjid for the Fajr prayer; he passes his time at night by watching televison and playing cards. So he stays awake until the prayer comes in(or until the early morning), but he does not pray until after the sun rises. Surely, I have warned him a great deal, and his excuse is that he does not hear the Athan, although the masjid is very close to us. So I stayed with him, hoping that I could awake him to go the Fajr prayer, so I would go to him and awaken him. But(still) I would not see him at the masjid, then after the prayer I would return to him and find him sleeping. So I would rebuke him, and he excuses himself with a feeble excuse. And sometimes he says to me, "You are responsible for me before ALLAH on the day of judgement because I am your neighbor".
I want from you(your esteemness) to give me some benefit on this(issue) And is it upon me to wake him up for the prayer?

Answer: It is not permissble for the Muslim to stay awake(long hours) so as to  cause him to miss praying Fajr in the Masjid or praying in its proper time. Even if he stays awake reading the Qu'ran or seeking knowledge, so how about staying awake watching televison or playing cards or similar activities?

And this is an evil action that deserves the punishment of ALLAH. Just as this deserves the punishment from the Amir(leader of the Muslim affairs) so as to prevent him from doing this.

And delaying the prayer until after the sun has risen is major kufr, if done on purpose; according to all of the people of knowledge. By the statement of the Prophet,صلى الله عليه وسلم  , "Between the man and between shirk and kufr is the leaving of the prayer". Related by Muslim. And by His statement, صلى الله عليه وسلم , "The agreement between us and between them is the prayer, so whoever leaves it has disbelieved". Narrated by Imaam Ahmad. (أخرجه الإمام أحمد ، وأهل السنن ، عن بريدة بن الحصيب رضي الله عنه بإسناد صحيح ).
And from other hadith and narrations that prove the kufr, of the one who lets the prayer go out from its time without an excuse from the Share'ah(Laws of ALLAH)
It is obligatory for the Muslim to protect his prayer by praying them in their proper times. And to seek help in that, by those that wake him up, like his family or his brothers(in Islam), or by setting a clock that will wake him up for the prayer times.
And it is upon him and those like him to not stay awake(long hours) such as to cause him to miss the Fajr prayer; even if they stay awake doing something which is permissible or recommended. So how about the one who stays awake doing something haraam. (not permissible) Like watching those haraam things on television or things like that. May ALLAH rectify all our conditions.
And it is upon you, oh questioner, to help him with this, and advise him alot. And if he stays upon this evil action, then report him to the proper authorites so that they can follow up on him, in a way that he deserves.  
And it is not upon you to stay with him as long as he continues upon this evil action, and he is not benefitting from being awaken nor taking any other measures.
We ask ALLAH to guide us all and to make us firm upon the truth.
