A persons? life in this world is not stable. One passes through alternating periods of happiness and dismay, strength and weakness. Wealth, poverty, health and sickness; a true believer is one who maintains a clear level of Eemaan throughout the worldly fluctuations. He continues to remember Allah and ascribe the bounties to Him; and he turns to Him in submission, asking for relief from his affliction. This is described by the Messenger sallallaahu alaihi wa sallam who said: "Indeed amazing are the affairs of a believer! They are all for his benefit; If he is granted ease of living he is thankful; and this is best for him. And if he is afflicted with a hardship, he perseveres; and this is best for him." [Muslim]
Allaah The Most High said: "Certainly, We shall test you with fear, hunger, loss of wealth, lives and fruits; but give glad tidings to the patient - those who, when afflicted with calamity say, "Truly to Allah we belong, and truly to Him shall we return." it is those who will be awarded blessings and mercy from their Lord; and it is those who are the guided ones." [Soorah Al Baqarah 2:155-157]
Thus, a believer shows gratitude and thankfulness for all the wonderful blessings that Allah grants him. And he displays patience and submission during sickness and hardships, hunger, or other afflictions.
Abu Hurayrah reported that the Prophet sallallaahu alaihi wa sallam kissed Hasan while Aqra? Ibn Habis was sitting nearby. Aqra said: ?I have ten children and have never kissed one of them.? The Prophet looked at him and said: ?Those who show no mercy will be shown no mercy.?
The Prophet sallallaahu alaihi wa sallam said: ?He who does not show mercy to our young or show respect for our elders is not from us.? [Ahmed]
To all my dear Salafi brothers and sisters please read the following putting yourself in the shoes of this sister and ask yourself ?What would I be willing to sacrifice if someone was going to take my son or daughter, niece or nephew, grandson or grand daughter away from me for no other reason other than hatred of Islaam.
The sister is 30 years old and resides in the USA she became Muslim and Salafi one year ago. She is married to a Salafi brother and has two young children. They are both regular attendees at the Salafi Masjid ?Masjid Uthaymeen?.
The son is from her previous marriage before she became Muslim. She separated quite a few years ago. Her ex-husband had no real concern for her son and had not given any financial assistance or other help in bringing him up. She has totally taken care of him from the time of the separation that included all school fees, healthcare, clothing, feeding etc. and has never abused or harmed him. The boy has expressed his desire to stay with his mother as well.
When she became Muslim, this is when the problems started. The boy?s father did not want his son to be brought up as a Muslim and has now filed a Lawsuit against the sister for full Custody of the child. The father of this child and all his family will not rest until they remove Islaam from him.
The Custody Case should have been straightforward as in America the only way a father will get custody of a child over a mother is by proving that she is not able to take care of the child; this would not happen. What has happened in this case is that the father has filed for a Jury Trial. The venue for the Trial is a racist and anti-Islamic region of America and is also where part of the US Army is based. The opposing Attorney is hoping to get a Jury consisting mainly of soldiers and they will put her (as a practising, covering Muslim) and Islaam (Salafiyah) on Trial. The fathers Attorney has taken on this case free of charge as she feels it is some kind of Crusade against Islaam (Salafiyah). Qadarallaah the sisters Attorney understands what is at stake but is still charging a fee. He needs a ?down payment? of $10,000 and charges $200 per hour and has estimated the trial in total will take 5 days so as you see it could work out to a huge sum of money which the sister just does not have. The Attorney mentioned that the minimum it will cost is $10,000 and the maximum is around $40,000! The sister has currently raised $2500 herself but is really struggling. By the way the boys father is hoping that the sister will not be able to raise the funds so will have no Attorney to represent her in court and will thereby be 'torn apart' (as stated by her Salafi husband) by the opposing Attorney. That is part of the plan... soldiers on the Jury and no Attorney.
The reason why we at ?Markazus Salafi? Manchester UK are aware of this situation is because we received a letter from the sister appealing for help during the last week of Ramadhan. We contacted one of the Committee members of ?Masjid Uthaymeen? (Abu Aasiyah) who has verified the story; we then spoke to the husband of the sister who gave us more details of the situation and then we decided to get in contact with the sister for more verification.
Since then, we have also sought advice from a sister who is an Attorney in New York, USA, she advised us to get hold of the ?Court Reference Number? so that we could get in contact with the Court in the USA. She also advised us to get a breakdown of the Attorneys fees. We obtained both of these from the sister recently and called the Court directly and verified that the Custody Case was indeed a Jury Trial between the sister and the boys father and that it was on the 30th January 2006 (Pre-trial one week before that).
During this period e-mails have been exchanged with the sister regarding different queries, questions and requests.

At the least make dua for her because no matter what we do or how much we raise its will be of no benefit except by the help of Allaah The Most High. She needs at least $7500 dollars by the end of December 2005 and will need more money soon after that! Please inform any contacts that you may have (that maybe able to help) and please make plenty of dua? for her. Any ideas or input to help this situation will be greatly appreciated. Verily the Reward is with Allaah The Most High and the Reward is Great. I have discussed this issue with some of the brothers at ?Salafi Publications? The Messenger of Allaah sallallaahu alaihi wa sallam: ?Whoever relieves a believer of some of the distress of this world, Allaah will relieve him of some of the distress of the Day of Resurrection. Whoever makes things easier for one who is suffering hardship, Allaah will make things easier for him in this world and in the Hereafter. Whoever conceals a Muslim?s faults, Allaah will conceal his.?
The Prophet sallallaahu alaihi wa sallam said: ?Save yourselves from the fire even if it be with half a date and if you do not find that then a good word.? [Bukhari and Muslim].
He sallallaahu alaihi wa sallam said: ?There are seven that Allaah will shade on the Day when there will be no shade?a man who gives charity in secret that his left hand does not know what his right hand has given??
The Messenger of Allaah sallallaahu alaihi wa sallam said: ?Charity is due upon every Muslim.? So they asked: ?O Messenger of Allaah, what of the one who cannot find anything to give?? He replied: ?He should aid the one who has a need he who is worried and the one who is distressed?? [Bukhari and Muslim]

InshaAllah, this letter finds you all in the best of health and Iman during this Ramadan.
My dear brothers and sisters in Islam, I am coming to you with a plea for help. My name is Sister Sarang, and I am a relatively new Muslim. I made Shahada just over a year ago, Alhamdulillah. I have a little boy named Kain/Qabeel who is 8 years old. His father and his family (non-Muslim) have sued me for custody of my child. They are anti-Islam and do not feel that Kain should be raised in an Islamic environment.
When I was initially sued for custody (Dec 2004), I was able to retain an attorney for $2500. We should have gone to court over a month ago (August 2005) but his attorney was granted an extension. Now that it is almost time to go to court again, they are requesting a trial by jury!
SubhanAllah. This is HIGHLY abnormal for a simple case like this! They believed the judge was going to rule in my favor, so they have decided to take the decision out of the judge?s hands, and put it into the hands of a jury of my so-called ?peers?.
It is very hard in the state of Texas for a man to get custody of a child that has been in the care of his mother, and the presiding judge over my case is known as a ?MOMMA?s judge? meaning he usually decides in the favor of the mother. The city that the trial is being held is in Killeen/Ft.Hood, TX, where I was raised. I do not feel that I will get a fair hearing because it is an ARMY city, because I am practicing and covering Muslim, and because we are in the middle of a war. They are using my appearance as a Muslimah as a tactic to take my child from me. These people want to put Islam on the stand and slander me.
Even though they will be unable to prove me an unfit mother, I am afraid they will be judging Islam and not me. Believe me when I say it is highly ABNORMAL for a child custody case to go into jury trial, which proves how intent these people are to get my child! I separated from Kain?s dad in 1999, and have provided for Kain all this time by myself, never asking him for child support. As a working mother, I have paid all health insurance costs, medical, dental?everything! I have NEVER abused, neglected or mistreated my child. His father moved over a hundred miles away from Kain on his own accord in 2000, so Kain does not see him as often as he should. Since he sued me for custody this year he has just now started paying me court-ordered child support!
With this case going into jury trial, my legal retainer fees have gone up! I now have to pay my attorney an additional $10,000 dollars, and I am asking for the help of my Muslim Ummah. If somehow these non-Muslims are granted custody of Kain, they will immediately begin to reverse all of the Islam in him.
Kain loves Allah! Kain loves being Muslim! He loves going to Islamic school, he loves praying with me, and looks forward to being my Mahram! He loves going to Masjid and being with the other boys his age. Kain loves going to Iftar. Kain loves waking up for Fajr prayer. Kain has already learned a couple of surahs and is learning how to read and write in Arabic and learning dua! Kain has expressed to me his desire to remain with me, he does not want to go to his non-Muslim father. Please, if anybody has the ability to help in this matter?my attorney is ready to help me, and he realizes what is at stake. I have a limited amount of time to get these fund together. InshaAllah, Islam will prevail in this matter! Allah tests the ones he loves, and I know I am being tested. This type of thing makes my Iman stronger. These people are trying to break me?force me to give up my child because I don?t have $10,000 dollars! My child is not for sale! SubhanAllah. JazakAllahu Khair for all of your efforts. Allah burdens not a person beyond his scope. He gets rewards for that (good) which he has earned, and he is punished for that (evil) which he has earned. ?Our Lord! Punish us not if we forget or fall into error, our Lord! Lay not on us a burden like that which You did lay on those before us (Jews and Christians); our Lord! Put not on us a burden greater than we have strength to bear. Pardon us and grant us Forgiveness. Have mercy on us. The case is on 30th Jan 2006 and she has to produce $10,000 minimum by the end of December as a retainer fee for the Attorney. As salaam alaikum to all my beloved brothers and sisters. Alhamdullillaah, Allaahu Akhbar Allaah is Great. Jazakallaahu khairun for all of your noble efforts for our Salafi sister in the USA. The dua and funds have reached the sister and the retainer and Insha'Allaah Attorney costs have been raised. She wants to write a letter of thanks to be posted up here but I have told her to wait until the Trial is over. I have spoken to the Attorney today he will be getting on the case. All the articles/tapes against terrorism etc. have been sent to the sister to add to the case so that the opposing cousel cannot use Islaam against her in any shape or form. Apparently it will not be allowed anyway.
All I need from you now is to make plenty of dua and stop sending money but just have funds ready in case we need more. We will know more closer to the trial date (end of January). One day we will be reminded of this the Reward is with Allaah and the Reward is Great!

From Abu Umar Aaquil to my dear Salafi brothers and sister.
First of all please forgive me for not filling you in sooner on the result of our sisters Custody Case. QadrAllaah the sister lost the case and her son Qabeel has gone to live with his kaafir father. The father got full Custody of the child. Alhamdullillaah ours sister Umm Qabeel has show great patience and resolve in these hard time and may Allaah the Most High keep her firm and upon that way...Ameen. Please continue to make dua for our sister that Allaah Make it easy for her and that her son (who loves Salafiyah but is only 8 years old...soon to be 9) remains intact upon the best way.
I myself have been through a lot of emotions during this case how much it has affected me but I knew that when the result came that Allaah the Mighty and Wise is the Best of Planners and good will come from this no doubt as we all know the verses regards the burden Allaah put upon a people and that Allaah Knows what is good and best for His servants.
I would like to express my gratitude to first and foremost Allaah The Most High Who gave 'Markazus Salafi' the honour of helping our Salafi sister in the USA and forming a very strong alliance with our Salafi families in the US, Allaah then my dear brothers at 'Maktabah Salafiyah' in Birmingham in particular who took the time to look over the evidence and research that had been gathered in investigating the legitimacy of the appeal and case then giving the 'go ahead' to post the 'Appeal' on 'SalafiTalk', Allaah then the brother(s) who put the Appeal on 'SalafiTalk', Allaah then Abu Halimah Naeem from Stoke on Trent who helped in compiling the Appeal, Allaah then my noble brothers and sisters in Saudi who raised approximately £2300, Allaah then my noble brothers and sister in Stockholm who raised nearly £1000, Allaah then my noble sisters in Wales who raised around £300, Allaah then all the other brothers and sister who gave £60 here and £80 there and Allaah then my noble brothers and sisters in Manchester who raised in the region of £2000...two of which gave £500 each. In life there is no need to ask, "Where is the help of Allaah?" as Allaah the Most High brings Help from places you could never have imagined! May Allaah Bless you all that donated, all that made dua and all that would lay in bed worrying about their sister and how it must feel knowing that you have children yourself.

The trial started on January 30th and lasted 4 days and SubhanAllah the strategy of the opposing counsel worked in their favor and custody of my child was taken from me and given to his father. Of the 12 members of the jury, only 2 decided in OUR favor and those 2 were the ONLY 2 African American people on the entire jury. I was unable to question the members of the jury (I have the right to do so and they have the right to respond or refuse) as to why they decided to take my child from the only home he has ever known because as soon as they were able they FLED the courthouse SubhanAllah. The bailiff (officer of the court and good friend to my father) that was in with the jury during their deliberations stuck around and told us what he heard. Their reasons were?.Since Kindergarten to present my son had a few TARDIES (ie late attendances)? ALTHOUGH he had straight A?s in class and only a few absences due to EID holidays. Also I was helping my pregnant sister and her husband get on their feet so I opened my home to them (this is what FAMILIES do for each other) as they were relocating to Texas from New York, they had stabilized and MOVED from my house since then (they were only in my home a few months) they had issues with the other people that had been living in the house. Such pettiness is truly despicable. Even after we were able to show HARD evidence (bank statements, receipts and documents) that his father had not financially supported him since 1999?after I and other witnesses testified I had to FORCE the man to see his child, after witness testimony of how when he had the child he would leave him with people even while he was not working, even after we caught him and his attorney telling lie after lie?they still ruled against us, SubhanAllah. So now I have to pay HIM child support and visit my son 2 weekends out of the month. Allah is the Best of Planners and I will continue to be patient as I know I am still being tested and this is a good thing MashaAllah. I know my son is ok?he was upset and crying with me the day I told him he had to go to his father, but children are quite resilient MashaAllah and I never talk bad to him about his father although this was not always the same on his fathers side. I told my baby right before I had to turn him over to his father? ?Remember the MOST IMPORTANT THING?La illaha illa Allah?.because you will soon see that the people you are around now will tell you other things that are against Islam? and my baby replied to me? ?Ummi, I will watch out for all that SHIRK don?t worry about me? SubhanAllah?my son had to calm ME down?.SubhanAllah it was almost as if our roles were switched. InshaAllah, when my son turns 12 he can then choose for HIMSELF (state LAW) where he wants to be. Until then, all we can do is keep teaching him Tawheed, Soorahs?how to pray?I pray Allah protect him from the influences of those kufaar?.and pray the next few years fly by. The jury never once considered the feelings of the CHILD!!! The jury had issues with his tardies but not once questioned why he was pulled out of school (Subpoenaed) by the opposing Counsel and forced to be present for the duration of the trial. SubhanAllah, My son asked me? ?What of my brother and my sister??, ?What of my best friend??, ?What of my things??, ?What about my class mates I never got to tell them goodbye??..these people?the Shaitan is their best friend?may Allah guide them. I am doing fine now Alhamdulillah, the first and second day were the hardest for me but even then I was patient, I never let those people see one single tear fall down my face. They ruled against ISLAM and Salafiyah?not me?I did not stand a chance as soon as they saw the Hijab, the verdict was already made. Those Shayateen lied during the interviews (Jury selection) and said that they could be impartial and not judge because I was Muslim?but this is the nature of the Shaitan. The jury selection was such a joke?I must say the pickings were quite slim and anybody that remotely LOOKED like they would rule in my favor, the opposing Counsel struck them from the list right off the bat. Please keep us in your Dua?InshaAllah?.we will see how things go as I plan to appeal the decision as soon as I can InshaAllah. JazakAllahu Khair to all of you, my dear brothers and sisters? for being there for us during this rough time, making dua for us, donating to our cause?wanting for us what you would want for yourselves, May Allah reward you all with the best of this life and the Hereafter Ameen?. and although things didn?t go as we wanted them to go? it is QadarAllah and some good will come out of all of this. My son loves to wear thobe and kufi?so InshaAllah I plan to get plenty of those?one for EVERYDAY of the month ?.InshaAllah?.that will drive his family crazy but who are they to tell a child that he cannot be Muslim?!!! I DARE THEM! My son?loves Islam?it is too deeply instilled in him for them to think they can remove it easily ?if at all?. we will be there each step of the way to fight this! InshaAllah I will get all types of Islamic childrens books and things of that sort for his bookcase in his bedroom, he has told me already that he has a LARGE space reserved just for that purpose MashaAllah. Subhaan-Allah may Allah make it easy for us and for the sister in her difficulties and for the muslim ummah.
I read this today and it is about five years after the original post. I was wondering if there was any new information regarding the turnout and if there was still any help that could be offered, Baarak Allahu Feekum.
