Salamu alaikum wa rahmatullah;

Is anyone familiar with Shaikh Hani al-Jubayr? I recently read a fatwa by him permitting Muslims to resort to non-Muslim courts in non-Muslim countries as "matters of necessity." If after exhausing all Islamic avenues
available in non-Muslim countries. Of course, he emphasized the obligation and need for Muslims to first make attempts to solve matters amongst themselves.

the same was said by shaykh Fawzee, in the Lectures he had in Philadelphia. If i recall he used the same explanation, that it has to be a last resort to solving a situation. the example the shaykh used (and i believe that was from an actual question) was that if a woman had a child from a previous marriage and the child's father doesn't pay any money to the upbringing of the child, is the woman allowed to seek assistance from the courts of the kuffaar? The Shaykh said yes, as long as the person has exhausted all means islamically and has to now resort to the court system, providing that the sister understands that she is seeking only what islaam allows her and that she knows that the court system of the kuffaar isn't above the laws of islaam.

wa alaikum salam wa rahmatullahi wa barakatuh;

Jazakallahu khairun ya akhee, Al-Hamdulillah, I have since that Post received also a PM from brother Yoosuf Abu Safr confirming that Shaikh Abdur-Razzaaq [rahimahullah] had also given this fatwa. Shaikh Hani al-Jubayr is a judge in the Supreme Court in Saudi, but I wanted confirmation from known People of Knowledge who took this position. I guess my real question was: Does anyone know of Shaikh Hani al-Jubayr's manhaj? But at this point it doesn't really matter, since the People of Knowledge have said this and that's what matters most to me. Thank you & may Allah Ta'Ala reward you.
