Assalaamu Alaykum Wa Rahmatullaahi Wa Baraakatu

A brother asked me a question and i didnt have the answer to it:

"If a husband holds the posistion that the Niqaab is obligatory and the wife holds the posistion that the Niqaab is just something highly liked and she prefers the Jilbaab instead, can the husband order his wife to put on the Niqaab?"

And my question in regards to this is: is there a sin upon the wife if she disobeys her husband's command?

Inshaa'Allaah if anyone has any statements from the Salaf or Ahlul-Ilm or if someone has any knowledge regarding this issue, then please reply, Jazaakumallaahu Khayr.

Here is a fatwa from Shaykh Muhammad Nassir-ud-Deen al-Albani (Rahim Allaah)

Question: If a woman disagrees with her husband over a Fiqh issue, such as traveling without a mahram, then in general, can he force his Fiqh opinion on her?

Answer:

الرِّجَالُ قَوَّامُونَ عَلَى النِّسَاء بِمَا فَضَّلَ اللّهُ بَعْضَهُمْ عَلَى بَعْضٍ

"Men are guardians over women due to what Allaah has favoured some of them over others with." [Surah An-Nisaa: 34] So with regard to the likes of this question, the opinion of one of the spouses - either the wife or the husband - must be carried out. And there is no doubt that so long as Allaah, the Mighty and Sublime, has made it obligatory upon the woman to obey the husband, her opinion is not a decisive factor. So in this situation, she must obey him. However, before that, they must first yield to one another and communicate to try to come to an understanding with one another. But if (after doing this) the situation has reached the point at which the question was asked, then the answer is that (at this point) it is obligatory upon her to obey him and to not oppose him. [Al-Asaalah, Issue #19]

wa 'alaykumus-salaamu wa rahmatullaahi wa barakaatuh

As a general principle, people in authority over you are to be obeyed in all halaal matters.  So if her husband requests her to do something halaal, (in this case mustahabb - in her opinion), then a good wife should have no problem doing it, since obeying her husband is a duty upon her.  If he requests her to do something haraam, then she must not oblige him.  And Allaah knows best.

It should be noted that Sh. Fawzaan's position on the niqaab is that it is obligatory, so it would be obligatory for the husband to order with it, and obligatory on her to obey him, not because he has ordered it, but because it is a religious obligation.

As-salam 'alaykum  wa rahmatullah wa barakatuh,

I have a doubt:

What if both of them believe the issue to be mustahabb? I mean, is it permissible for the husband to demand that his wife do something that he believes is mustahabb? Even if she finds it difficult to do so? For instance, is it correct that a husband demands that his wife prays qiyamul-layl or do any mustahabb act and that he reproaches her if she does not do so? Is she committing a sin if she does not obey him, after explaining that she finds it difficult to do that act?

In summary: Is it allowed for a husband to compel his wife to do any mustahabb act of 'ibadah and to reproache her if she does not do it? Is the wife a sinner if she does not do it, either because she finds it difficult or because she does not "feel like" doing so?

could someone please explain to me what is meant by " If a woman disagrees with her husband over a Fiqh issue, such as traveling without a mahram.."

I thought it was wajjib that a woman travels with her mahram and that it was not something to disagree over. Inshallah i would appreciate it if one of the students of knowledge clarified it to me.

There is some difference of opinion between some of the Scholars as to the distance/time a woman must travel for it to be considered traveling. I think that is what the Shaykh is refering to wa Allaahu alim.

can anyone tell me if ur a sister and ur position towards the niqaab is that it is fardh, but ur parents(who aren't practicing)don't want u wearing it, do u have to obey your parents in this regard.inshALLAH could a brother or sister shed some light on this sissue for me jazakALLAHu khairan in advance and inshALLAH with daleel frm quran sunnah or the ulamah.
