Title of the question: Fatwaa regarding the dealing of a man with his wife who is rebellious against his obedience
Text of the question:
In the Name of Allaah, the Most Merciful, the Giver of Mercy
As-Salaamu ?alaykum wa rahmatullaah, To proceed:
Verily we praise Allaah to you, Noble Shaikh, the father, Yahyaa bin ?Ali Al-Hajooree. I seek from you (may Allaah preserve you) a legislative Fatwaa (religious verdict) regarding my personal matter, and it is that I am married to a woman who works in an institution where there is mixing ? men and women mingle there. Along with this, she (my wife) does not adhere to the legislative hijaab (modest Islamic attire for women), from the covering of all of her body. So I have advised her, and I have been stern with her, but she pays not attention (to what I say). Rather, to the contrary she said, ?My job, not my husband? (i.e. I choose my job over my husband). Along with this she commits some other things, like eating Al-Qaat (a narcotic plant grown in East Africa and Southern Arabia; actually it is chewed), and smoking the Madaa? (hubbly bubbly pipe for smoking tobacco and other things, also known as Sheesha, Argheeli and Hooka in other countries). Indeed I used to have a television set, but Allaah bestowed his favor upon me allowing me to repent, so I smashed it leading to a dispute between her and me.

Our noble Shaikh, this is my situation, so what is your advice to me, and the ruling of the Islamic Law regarding this woman remaining with me upon this state of affairs. Please benefit us, and may Allaah reward you, bless you and grant you success.

Text of the response:
In the Name of Allaah, the Most Merciful, the Giver of Mercy.
Wa ?alaykum us-salaam wa rahmatullaahi wa barakaatuhu.

It is obligatory upon this wife of yours to obey you in the good that you have commanded her with, from the affair of adhering to the legislated hijaab, and staying away from mixing with men who are not her relatives, and staying away from eating Al-Qaat, and from smoking. And if she comes away from that (these wicked things), then all praise is due to Allaah. And if she falls back to what she was upon (of these matters), as you have mentioned that she says that her job is given precedence over her husband, then I advise you that if she doesn?t repent from that, that you divorce her so that you are not exposed to carrying her burden of sin. This is from the statement of the Prophet (sallallaahu ?alayhi wa sallam): ?Each of you is a shepherd, and you will be questioned about your flock.? And also from the matter of being lax regarding the responsibility of maintaining that is mentioned in the statement of Allaah, the Most High: ?The men are the maintainers and protectors over the women.? [An-Nisaa?:34] And Allaah, the Mighty and Majestic says: ?You will not find a people who believe in Allaah, and the Last Day, loving those who oppose Allaah and His Messenger.? [Al-Mujaadilah:22]
And the Prophet (sallallaahu ?alayhi wa sallam) said, ?The likeness of the righteous companion, and the wicked companion, is like the carrier of musk perfume, and the one who blows into the bellow (blacksmith).? And he said, ?The man will be upon the Deen (way or religion) of his friend, so let each of you look at whom he befriends.?
And because her continuing in these matters is something that will lead to her being tested. And the Most High said, ?So let those who oppose his command beware, lest they be afflicted with a trial (fitnah).? [An-Noor:63]
And if she is put to test, then indeed you will be burned by the fire of her test. And avoiding the trials is a matter that is obligatory. The Prophet (sallallaahu ?alayhi wa sallam) said, ?So whoever finds a place of protection or a place of refuge, then let him take refuge in it.?
And he said, ?Verily the happy person is the one who has been kept away from the trials (fitan).?
