AS SALAAMU 'ALAIKUM WA RAHMATULLAH
CAN SOMEONE EXPLAIN POINT 4- SOME CASES WHERE IT IS PERMISSIBLE TO BACKBITE BY AN NAWAWEE....
One who critisizes those who openly commit acts of disobedience , such as drinking wine, gambling, engaging in immoral habits, fornication, hypocrisy, and making mischief.
Example; Is it ok if in a gathering where the topic is gambling for one to say "I know a brother or sister who told me they gamble all the time"? Or like this without mentioning the person's name.
I would like for a student of knowledge to explain how this Point(4) is applied(incorrectly and correctly), if possible.

assalamu 'alaikum,
I asked sheikh Obayd al Jabree a similar question and he said those who have open sins like drinking alcohol or fornication and the ahlu bid'a for them there is no harm in backbiting them to warn the Muslims from accompanying them. This to look after the society at large from the evil that these people do.

BARAKALLAHU FEEKUM
YAH ABDULILLAH,
SO HOW ABOUT IF ITS NOT IN A WAY OF WARNING.... JUST MENTIONING THE SINFUL ACTION,WITHOUT NAMING THE PERSON, WILL IT ALSO BE AS A "WARNING"?
EXAMPLE.....WARNING: SO AND SO HAS COMMITTED THESE SINS.....STAY AWAY FROM THE BROTHER OR SISTER....
HOW ABOUT....EXAMPLE: THE STATEMENT: I KNOW A BROTHER WHO STOLE MONEY.......
MEANING:
SAYING IT JUST TO SAY IT AS CONVERSATION....THATS WHAT I MEANT IN MY QUESTION ....WILL THIS STILL FALL AS BEING PERMISSIBLE.....OR WILL IT FALL INTO GOSSIP?
I HOPE THIS CLARIFIES THE QUESTION A BIT MORE...

Sheikh Obayd ibn Abdillah al Jaabree said "If a person openly sins and his sin has become so apparent and spread until even the people know about him then he is to be warned against since this will be a lesson for him however mentioning what he does to the people should be from the angle of warning against him not from the standpoint of just mentioning it for the sake of it. It should be from the standpoint of warning. However if his sins are just known to a few and it has not become so openly known then for this one he is to be advised and he is to be spoken to fear Allaah and stop this action. "

Sheikh Rabee' advised last week that if errors are committed by salafees then they should be advised to take back their errors and if we see stubbornness and pride from them accepting the truth then we leave them.
Sheikh Obayd also said on this topic that advice has to end with one of the two results either the person accepts it or he rejects it.

Your post together with the khutbah(5/14/04-from the explaination of Riyaadus Saliheen by Shayhk 'Uthaymeen-rahimahullah) by our brother Abu Uwais- May Allah make your(you and him) scales of good deeds heavy on the Day of Judgement-Ameen!- has clarified the matter.
