Fataawaa Series from the Scholars in Yemen - 5

By The-Muhaddith, Sincere Advisor, and Successor to Shaykh Muqbil in Dammaj

Abu Abdur Rahman Yahya ibn Ali Al-Hajoree (may Allah preserve him)

1. Question: Is the prostration mark on a personıs forehead included in the meaning of the verse

The mark of them (i.e. of their Faith) is on their faces (foreheads) from the traces of (their) prostration (during prayers). [Fath29 ] ?

Answer:  No, this mark can be a result of rough carpet, dirt, or long prostrations made sometimes, etc. To refer this mark as being mentioned in the verse is wrong; since the one mentioned in the ayah refers to light. The mark of them (i.e. of their Faith) is on their faces (foreheads) from the traces of (their) prostration (during prayers). [Fath29 ]

This is about the traces of the religion. People say the people of Hadeeth faces have light due to Hadeeth. The Prophet (peace and blessings be upon him) said,

May Allah brighten the face of the person who hears what I say and retains it, then conveys it to others the same way he heard it [Abu Dawud 10/94, At-Tirmithi 7/41 and others]

This refers to the light on the people of Hadeeth faces, even if they are very dark faces. This is what is intended when Allah said, "The mark of them (i.e. of their Faith) is on their faces (foreheads)."
On the contrary you'll find sinners with traces of disbelief and sin on their faces. The dust color overwhelms them even if they eat delicacies.

2. Question: Is it true that during a solar eclipse the Moon passes between the Sun and Earth and covers the Sun's light?

Answer: That statement calls for careful study. Allah says

"Allah merges the night into the day (i.e. the decrease in the hours of the night are added in the hours of the day), and merges the day into the night.." [ Luqman 29] ,

"And the sun runs on its fixed course for a term (appointed). That is the Decree of the All-Mighty, the All-Knowing." [Ya-seen 38  ]

"It is not for the sun to overtake the moon, nor does the night outstrip the day. They all float, each in an orbit." [ Ya-Seen 40 ]

Each one has its orbit. To say the Moon covers the Sunıs light is incorrect.

3. Question: Is it correct that dua during rain is answered?

Answer: There are some hadeeth which mention dua being answered during downpour; however none of them are authentic.

4. Question: Is shaving the head for other than Hajj and Umrah disliked?

Answer: Imam Ahmed and others view this act as being disliked. I consider it as permissible due to a need. Having a bald head resembles the hair style of the Khawarij. The Prophet (peace and blessings be upon him) said,

"There are some people from my nation who are bald headed. They read the Quran but it doesnıt go beyond their throat. They pass through the religion the same way an arrow passes through a bow. They are the worst of creation with the evilest of characteristics." [Muslim ]

5. Question: Who are the people of Al-'Araf?

Answer: They are the people between Jannah and Jahanem .Their good deeds weigh the same as their bad deeds. Their good deeds prohibit them from entering Hell and their bad deeds prohibit them from entering Paradise. Nonetheless in the end they enter Jannah. Allah says,

And between them will be a barrier screen and on Al-A'raf (a wall with elevated places) will be men (whose good and evil deeds would be equal in scale), who would recognise all (of the Paradise and Hell people), by their marks (the dwellers of Paradise by their white faces and the dwellers of Hell by their black faces), they will call out to the dwellers of Paradise, "Salamun 'Alaikum" (peace be on you), and at that time they (men on Al-A'raf) will not yet have entered it (Paradise), but they will hope to enter (it) with certainty. And when their eyes will be turned towards the dwellers of the Fire, they will say: "Our Lord! Place us not with the people who are Zalimun (polytheists and wrong-doers)." And the men on Al-A'raf (the wall) will call unto the men whom they would recognise by their marks, saying: "Of what benefit to you were your great numbers (and hoards of wealth), and your arrogance against Faith?" Are they those, of whom you swore that Allah would never show them mercy. (Behold! It has been said to them): "Enter Paradise, no fear shall be on you, nor shall you grieve."{ Al-Araf [46-49]

Al-'Araf is a place between Paradise and Hell.

6. Question: Is the origin of the Prophet's (peace and blessings be upon him) speech revelation?

Answer:  Yes, This is established in the verse

I swear by the star when it goes down. Your companion does not err, nor does he go astray; Nor does he speak out of desire. It is naught but revelation that is revealed. [An-Najm 1-4]

The Prophet (peace and blessings be upon him) said, " By the One in Whom My soul is in His hand nothing comes out of my mouth except the truth ."[ Abu Dawud 1/79]

This Applies to the Sunnah   The Prophet (peace and blessings be upon him) spoke  about debt saying " ,...except debt, verily Jibril informed me about it before."[ Muslim 1885]

Furthermore, the proof that his speech is revelation is found in the hadeeth when the Prophet (peace and blessings be upon him) prayed in his shoes and Jibril informed him that there were some impurities on them. Al-Amreetee said it best,:

Whatever occurred during the Prophet's life

And he became aware of it and agreed with it, then follow it.

7. Question: Does a person have to seek refuge in Shaytaan at the beginning of Fatihah in every Rakıat or is it enough to do it in the first?

Answer: It is enough to recite it at the beginning after the opening supplication. Allahıs says ,

So when you recite the Quran, seek refuge with Allah from the accursed Shaitan, [An-Nahl 98]

What is intended here in this verse applies to the reading of the Quran. The prayer is Takbeer , Tamheed, Tasbeeh and Quran recitation.
