As Salaamu Alaikum

A brother asks:

My wife's sister has leukemia and she needs a bone
marrow transplant. However, she's a disbeliever. Both
of my wife's parents are dead and my wife has one
brother who is also Muslim. My wife has come under
extreme pressure from her family to donate the bone
marrow. So I want to know if it's permissible to
donate bone marrow, especially to a disbeliever. Can a
student of knowledge please take this question to the
Ulema.

هل يجوز لي التبرع بنقل دم لمريض أوشك على الهلاك وهو على غير دين الإسلام؟

لا أعلم مانعا من ذلك، لأن الله تعالى يقول جل وعلا في كتابه العظيم: (( لَا يَنْهَاكُمُ اللَّهُ عَنِ الَّذِينَ لَمْ يُقَاتِلُوكُمْ فِي الدِّينِ وَلَمْ يُخْرِجُوكُمْ مِنْ دِيَارِكُمْ أَنْ تَبَرُّوهُمْ وَتُقْسِطُوا إِلَيْهِمْ )) [الممتحنة: 8].

فأخبر سبحانه أنه لا ينهانا عن الكفار الذين لم يقاتلونا ولم يخرجونا من ديارنا أن نبرهم ونحسن إليهم، والمضطر في حاجة شديدة إلى الإسعاف، وقد جاءت أم أسماء بنت أبي بكر الصديق رضي الله تعالى عنها إلى بنتها؛ وهي كافرة، في المدينة في وقت الهدنة بين النبي صلى الله عليه وسلم وأهل مكة تسألها الصلة، فاستفتت أسماء النبي صلى الله عليه وسلم ذلك فأفتاها أن تصلها، وقال: (( صلي أمك )) وهي كافرة.



فإذا اضطر المعاهد أو الكافر المستأمن الذي ليس بينا وبينه حرب، إذا اضطر إلى ذلك فلا بأس بالصدقة عليه من الدم، كما لو اضطر إلى الميتة، وأنت مأجور في ذلك؛ لأنه لا حرج عليك أن تسعف من اضطر إلى الصدقة.

Summary translation

Q: Is it permissible for me to donate blood for a blood transfusion for a sick person who is about to die even though they are on a religion other than Islam?

A: I don't know of anything that prevents this. Because ALLAH تعالى جل وعلا says in HIS great book, "ALLAH does not prevent you to deal justly and kindly with those who fought not against you on account of religion and did not drive you out of your homes. Verily, ALLAH loves those who deal with equity." (Surah Al Mumtahinah verse 8 Noble Qu'ran translation)
So the GLORIFIED ONE informed us that HE does not prevent us concerning the kurfar that don't fight us and that don't drive us from our homes, that we are kind to them and show them good treatment. And the one in this predicament is in great need for aid.
And Umm Asma bint Abi Bakr As Sadiiq, may ALLAH be pleased with her, came to her daughter(Asma), while she(Umm Asma) was a kafir. She came to her in need during the time of the truce between the Prophet صلى الله عليه وسلم and the people of Mecca, to ask her for help. So Asma sought a fatwa from the Messenger of ALLAH صلى الله عليه وسلم concerning this. And he ruled for her to help her mother. He صلى الله عليه وسلم said, "Uphold the ties of kinship with your mother." And she was a disbeliever. So if the person in need is one who has a truce with the Muslims or a kafir that is beneath the Muslims protection and there is not between us and them a war, so if they have a need for this there is no harm in giving them blood. ...and you will be rewarded for this...

In regards to your wife's situation, the response was?

?There is no exchange of blood between a Muslim and a non-Muslim.?

The Shaykh also asked if your wife?s sister was Christian, but we didn?t know (and made no assumptions).
