Bismillaah,
As salaamu 'alaikum wa rahmatullaah,
My son who is 18 months old is a breastfeeding baby. He will not, at all, drink from a bottle except from his Ummi breast. However, he eats solid foods with no problem. His mother who is my ex-wife is getting married, masha Allaah la quwwatta illa billaah. I will be taking custody of the child, insha Allaah. I need to know from any du'at, or someone who can refer this matter to a student of knowledge, or scholars, or someone who can bring with daleel of when can I exactly take custody of the child due to what has been mentioned above. Do I have to wait for the mother to stop breastfeeding in order to take custody of the child? And if yes, I do have to wait, and she keeps breastfeeding after his two years, do I still have to wait if she proceeds with the breastfeeding after his second year of age and she decides to end the breastfeeding months or so after his two years of age, then I take custody? Or, can I take custody of the child as soon as she gets married with no execptions? Also, what criterias/conditions does the father has to meet in order to take custody of the child? Please, it is very important, and with Allaah is your reward, that someone answers this question. Is it an issue of ikhtilaaf or is there ijma' on the issue. Please can someone answer the question from amongst our noble brothers who frequent this board, if able, answer the question. Or can brothers from amongst the du'at and students who have access to our scholars ask this question and post the answer on here. You would be assissting a brother, bi'ithnillaah, who is in very much of your need. May Allaah reward the one who takes the task tremendously for getting me an answer. Hayyakum Allaah.

Wa alaikum salaam,
Jaazak Allaahu khairan akhee fillaah. I have read this article before, and I ask Allaah to reward you for reminding me of it again. As I understood, I take custody of the child, due to my ex-wife remarrying, when the breastfeeding term is over. Is this correct? Also, someone told me if I can find someone who is capable of breastfeeding the baby under my care, than this is also sufficient for me to take custody of the child. Is this correct? Or is it better that the child stays with the mother until the breastfeeding period is over so that the child wont suffer any psychological damages? Yaa Abul Hasan, I dont wont to take a lot of your time, but if you can, can you please briefly tell me if Im wrong or right, as far as my understanding of the situation? Barak Allaahu feek
