Permissibility of Looking at other than the Face and Hands.

It is related from Abu Humayd (radiyallaahu 'anhu ? who saw the Prophet) that the Messenger of Allah (sallaallahu alayhi was sallam) said:
?When one of you proposes to a woman, there is no harm to look at her, even if you were to look at the one proposed to and she did not know.?
(Reported in Ahmad (5/424) and at-Tahaawee (3/14) )

1.If it comes to a mans heart that he wants to propose to a lady, then it is ok for him to look at her.?Saheehah Shaykh Al-Albaani: 1/201

On the authority of Sahl ibn Ali Hatmah that he said:  
I saw Muhammad ibn Muslimah following (strongly with his eyesight) Batheenah bin Adh-dahaak, he was on top of her roof, I said to him: ?Are you doing this and you are from the companions of the Messenger of Allah??  He replied: ?Verily I heard the Messenger of Allah say?? ? he quoted the above hadeeth.

2. If one of you was to propose to a lady (woman), then if he is
able to look at that which would call him to marry her, then he should do so.?  
Saheehah Al-Albaani: 1/204

Jaabir ibn Abdullah said:
?I proposed to a slave girl, so I used to hide from her, until I  
saw that which called me to (wed) marry her.?

So it is permissible to glance/look at more than the face and the hands, due to the generality of the ahadeeth that have preceded due to his Saying:- 2.


Understanding the hadeeth:

The hadeeth is a clear proof for the reason why we mentioned it, and supports this the action of the noble companion Jaabir ibn Abdullah and Muhammad ibn Muslimah done the same as him, as was mentioned in the hadeeth, which preceded it.  These two are sufficient as proof.
It does not (harm) affect us after this the madhab that limits the glance /look to the face and the hands only.  Because it is, this, limiting the hadeeth, without any text that specifies this, and also this is rejecting the understanding of the sahaabah without any proof.


These sayings are reported on Imaam Ahmad:
1.That he looks to her face and her hands
2.He looks to that which is normally apparent, like her neck, shins and its like.
3.He looks at all of her, that which is Awrah and that which is not.

Shaykh Al-Albaani said:
?The second narration is closer to the apparent meaning of the hadeeth and practise of the companions, and Allah knows best.?

Ibn Qudaamah said (Al-Mugni: 7/454):
?From the viewpoint that it is permissible to look at that which is normally apparent of her, because when the Prophet allowed her to be looked upon without her knowledge, then it is known that he allowed the look to be of that which appears of her normally, as it is not possible to single out the face with the look/glance, when other than it is also apparent.?

?So these three are from the best (elder) of the companions, one of them is the Khaleefah Ar-raashid, and they allowed the look to be at more than the face and the hands, and no one opposed them from the companions from what I know.?  (208)






وقال شيخ الإسلام ابن تيمية:
لا عيب على من أظهر مذهب السلف وانتسب إليه واعتزى إليه بل يجب قبول ذلك منه بالاتفاق فإن مذهب السلف لا يكون إلا حقا
