       Here are some questions and answers from Shaykh Ahmad An-Najmi?s book, which is called:
الفتاوى الجلية عن المناهج الدعوية

Q7: Has public criticism of the rulers on the Minbaar been mentioned in The Book (Al-Quraan) or The Sunnah?     

A7: In reality, the open criticism of the rulers is a newly invented affair. It wasn?t from the foundations of the Sunnah. The Prophet
-صلى الله عليه و سلم- said:

-<<ألا من ولى عليه وال, فرآه يأتي شيئا من معصية الله, فليكره ما يأتي و لا ينزعن يدا من طاعة>>

<<Is not the one who is appointed ruler, the Ruler? So, if he is seen with something of disobedience, then what he brings is to be disliked, but the hand of obedience is not to be removed from him>>

      In this way is the saying of the Prophet of guidance-صلى الله عليه و سلم-
     Therefore rebellion or public criticism of the rulers is not permissible on the minbaar; because the harm that results from it is greater than the benefits. The Prophet-صلى الله عليه و سلم- commanded the people with the giving of Naseehah (advice) to the common people and the nobles or people of status. He said, as is found in the hadeeth of Tameem Ad-Daari-رضي الله عنه- :

>>الدين النصيحة, الدين النصيحة, الدين النصيحة, قلنا لمن يا رسول الله, قال: لله, و لكتابه, و لرسوله, و لأئمة المسلمين و عامتهم<<  (رواه مسلم )

<<The Deen is sincerity (advice), the Deen is sincerity (advice), the Deen is sincerity (advice), so we said, ?To whom Oh Messenger of Allah?? he said, to Allah, to his book, to his Messenger, to the leaders of the mulims, and to the common people of the muslims.?>>

     But, advice to the leaders of the muslims should be in which way, and how should it be done? It is necessary that it be in private, in order that the ruler accepts the advice given to him. This is from the foundation of giving advice to the ruler. Usaamah bin Zaid-رضي الله عنهما- said to the one said to him, will you not talk (advise) to Uthman-رضي الله عنه-, so he said,

(أتظنون أني لا أكلمه إلا أن أسمعكم)...  صحيح البخاري

     ?Do you think that, verily I will not speak to him except that you hear?"

     What is meant is, I talk to him in private. Therefore the foundation is like this in the Sunnah, and whoever stands at the minbaar and says, ?This message is to King so and so, or minister so and so or the likes thereof, then he is in error. Rather it is upon him if he sees something grave in error to send his advice privately. So if its accepted, then Allah is praised-صبحان و تعالى- upon that, and if its not accepted, then it is known that he is free from this affair and there is nothing upon him after that.

Q8: Some of the students of knowledge have directed their criticism to a group from amongst the Du?aat (the callers), those that have made mistakes in the Minhaaj. Is this considered backbiting of them or not?

A8: The Da?wah (the calling to Allah) should be upon the way Allah-Azza wa jell- specified it to his prophets, whereas he says:

و لقد بعثنا في كل أمة رسولا أن اعبدوا الله و اجتنبوا الطاغوت)) (سورة النحل آية 36) ((

{{Indeed we have raised up in every nation a messenger (saying), worship Allah and avoid the Taaghoot (those that are turned to, obeyed, worshiped, or called on besides Allah).}} An-Nahl: 36  

     And He specified it for His Prophet Muhammad, the seal of the messengers-صلى الله عليه و سلم-, as He said:

قل هذه سبيلي أدعوا  إلى الله على بصيرة أنا و من اتبعني و سبحان الله و ما أنا من مشركين                                                                                                                                                                                                                                    
((Say: This is my way, I call to Allah upon certainty, I and who follows me, far removed is Allah from any imperfections, and I am not from the Mushrikeen (polytheists).. )) Yusef: 108

     So, whoever comes with a minhaaj, that opposes the minhaaj of the Messenger, and a tareeqah (a way), that opposes the tareeqah of the Messenger, then verily it is upon the Ulemaa (scholars) that they clarify this opposition, and that they clarify these mistakes, and whomever does not clarify these issues and is aware of it, then verily he is a sinner. If the clarification is done by a few of the Ulemaa, then this is sufficient. So the command in this obligation is sufficient, if a few fulfill its obligation, then the rest our free from the command. But if whomever steps forward to fulfill this obligation needs help in doing so, then verily it is upon all of them to come to his aid and support.
    
     So, whoever claims that it isn?t permissible to talk about these people, those that made up a minhaaj that opposes the minhaaj of the Messenger, and a way that opposes him-صلى الله عليه و سلم- , whoever claims this, then verily he is a liar wishing by that to destroy the commanding of good and the forbidding of evil and the clarification of the truth and the working together of righteousness and Taqwah (fear of Allah).

     And if he doesn?t have this intent, then he has followed the one that does, and was deceived by him. It is binding upon him to return to the truth, and that he leaves what he is upon from the saying that it is not permissible to oppose and talk about the one who falls into error concerning the minhaaj, or falls into error concerning the legislated methodology of calling to Allah.

  Salaamun 'alaykum wa rahmatullaahi wa barakaatuh,

This is a very beneficial piece. May Allaah reward the one who posted it and the one who translated it with good, and may He ta'alaa reward our Shaikh Ahmad An-Najmi and preserve him. However, when first reading it I noticed a couple of mistakes in translation. For example, the statement:

-<<ألا من ولى عليه وال, فرآه يأتي شيئا من معصية الله, فليكره ما يأتي و لا ينزعن يدا من طاعة>>

Was translated as: <<Is not the one who is appointed ruler, the Ruler? So, if he is seen with something of disobedience, then what he brings is to be disliked, but the hand of obedience is not to be removed from him>>

However, the correct translation is:
<<Indeed whoever a ruler comes into authority over him, and he sees him doing something of disobedience of Allaah, then let him detest what he (the ruler) does, and he should not remove (literally) a hand from obedience.>>

and the statement

(أتظنون أني لا أكلمه إلا أن أسمعكم)...  صحيح البخاري

Was translated as:  ?Do you think that, verily I will not speak to him except that you hear?"

It should probably be translated as:
<<Do you think that I do not speak to him unless I let you all hear?>>

   Jazakallahu khairaan yaa Aqeel!I benefited from your translation, barakaallahu feek. i was having trouble how to word it, as you know sometimes you know the meaning in the arabic context, but sometimes there is difficulty to bring it into english, plus my english skills are not that great.may Allah continue to bless you and use you as a tool to benefit the people. wa jazakallah ahsan jazaa

No problem akhee Isa. It was an excellent piece, wallaah. Everyone makes mistakes in translating, because sometimes your eyes miss things or you misread something. That's why editing is such a big help. Two sets of eyes are better than one. LOOOL

  Bismillaah Al-Hamdulillaah

Ziyaad ibn Kusaib al-Adawiyy said, "I was with Abu Bakrah beneath the minbar (pulpit) of Ibn 'Aamir. He was giving a speech and was wearing a fine garment. So Abu Bilal said, 'Look at our ameer wearing the garment of the disobedient.' Then Abu Bakrah said: Be silent. I heard the Messenger of Allaah (sallAllaahu 'alayhi wa sallam) say,
quote:
'Whoever demeans the sultan (ruler) of Allaah upon the earth, Allaah will humiliate him.'"
  

Shaikh Saalih ibn 'Uthaimeen (rahimahullah) said,
quote:
"So when speaking about the king by backbiting, giving him advice in the open and publicizing (his faults), when that is (but) humiliation of him, that humiliation for which Allaah has threatened the one who does it with humiliation and debasement, then there is no doubt that it is obligatory to carefully observe what we have mentioned - that he should desire to give advice in secret and other such things. This being for the ones who are capable of advising them, from among the scholars, those who visit them and mix with them, and by whose advise they find benefit, as opposed to those besides the (scholars)...."
(Maqaasidul-Islaam, p. 393)

Subhanak Allaahuma wa bihamdika ash-hadu anlaa illaaha illa anta astaghfiruka wa atubu ilayk  

If I said anything correct, then it is from Allaah (subhanahu wa taa'ala), and if I erred, then that is from me and shaytan.
